Josh Duggar’s appeal to be freed or retried in child porn conviction appears to hinge on legal technicality

Okay, so I’ve been following the Josh Duggar case obsessively, and it looks like there might be a tiny glimmer of hope for him… but it’s super complicated. Apparently, there’s some question about when exactly everything happened, and it could mess up his chances of getting a new trial or even getting out. It’s a technicality, honestly, but I’m glued to every update to see if this time thing actually becomes something big. It’s wild!

On Wednesday, the 38-year-old reality star appeared in federal court to ask a judge to overturn his conviction or grant him a new trial. His lawyers had previously pointed out eight problems with the case in their legal documents.

Duggar, currently held at the FCI Seagoville federal prison in Texas (approximately 10 miles south of Dallas-Fort Worth), attended the two-hour hearing remotely.

He is currently in prison, serving a sentence of approximately twelve and a half years. He was convicted in 2021 for possessing sexually explicit images of children.

Federal investigators stated that Duggar, a father of seven with his wife Anna, possessed a large number of images and videos showing the sexual abuse of children. This included depictions of very young children and acts of extreme cruelty.

The Daily Mail has reached out to representatives for the Duggar family for comment on the story. 

Honestly, it all came crashing down because of what happened years ago. Back in the early 2000s, Josh Duggar… well, he did terrible things to five young girls – his own sisters, four of them, and a babysitter. When that finally came to light, TLC immediately pulled the plug on the show in 2015. It was awful, and it’s something I, as a longtime follower, still can’t fully process.

Josh Duggar claims his previous lawyers failed to adequately investigate someone who had access to the computer where authorities discovered images of child sexual abuse, according to documents reviewed by People magazine.

In his court filing, he also asserted that a Justice Department expert lied while testifying and intentionally presented biased information to the court.

Duggar argued that the release of a police report about past allegations made it difficult for him to receive a fair trial, claiming it was unfair.

In August 2025, prosecutors with the U.S. Attorney’s Office in Western Arkansas stated in a court filing that Duggar missed the deadline for submitting his appeal.

Duggar says he mailed his appeal on June 24, 2025, which was the deadline. The Supreme Court had already rejected his previous three appeals a year before.

An examination of the mail logs showed Duggar didn’t send any of the letters in question. Only two letters were sent from the facility that day, and neither came from him.

According to the magazine, the judge stated that the question of the deadline is still being considered before the court addresses the specifics of the appeal.

The reality show featuring the Duggar family first premiered in 2008 as “17 Kids and Counting.” It followed Michelle and Jim Bob Duggar, a deeply religious couple from Arkansas, and their tradition of naming all their children with the letter J.

Recent developments involving Josh Duggar follow similar legal troubles for his younger brother, Joseph, 31, who is currently free on a $600,000 bond while facing charges of child molestation.

According to the Bay County Sheriff’s Office, Joe was involved in an incident while on vacation in Panama City Beach, Florida in 2020.

During the vacation, he asked the victim to sit beside him on the couch and covered her with a blanket. While they were sitting together, he inappropriately touched her, including manipulating her underwear and grazing her genital area, officials stated.

Duggar repeatedly touched the victim’s thighs. He later apologized for his behavior, and the unwanted touching stopped after that.
