Alec Baldwin sues New Mexico, claiming malicious prosecution
Approximately six months following his acquittal in the fatal “Rust” shooting case, actor Alec Baldwin has initiated a lawsuit, claiming malicious prosecution and defamation against the New Mexico district attorneys and law enforcement officials.
The 73-page legal document, submitted on Thursday in Santa Fe, NM, includes Kari T. Morrissey (special prosecutor), Mary Carmack-Altwies (1st Judicial District Attorney), deputies from the Santa Fe County Sheriff’s Office, and members of the Santa Fe County Commission as defendants. The document argues that county officials intentionally tarnished Baldwin’s reputation, and their pursuit of criminal charges against him infringed upon his civil liberties by unjustly depriving him of them.
The defendants are accused of being so determined to convict Alec Baldwin unfairly, they would do it regardless of the facts or legalities involved. They repeatedly tried to shift blame towards Baldwin for the actions and inactions of others, according to the lawsuit.
As per the lawsuit, Baldwin is aiming for unspecified compensation, which includes penal damages.
The defendants’ inappropriate and illegal conduct led to Baldwin experiencing significant previous and ongoing losses such as legal costs, lost income, intense emotional suffering, mental torment, and humiliation, according to the court filing.

In the Baldwin involuntary manslaughter case, the judge dropped the criminal charge upon uncovering what appeared to be a concerted attempt to hide or withhold relevant evidence.
In July, a judge dropped the involuntary manslaughter case against actor Alec Baldwin, originally scheduled for his third day in court. Instead, defense lawyers brought up fresh concerns about how New Mexico police and prosecutors managed evidence and cross-examined those trying to convict Baldwin for the October 2021 death of Halyna Hutchins.
The conclusion brought an end to nearly three years of turmoil for the actor known for “30 Rock” and “Hunt for Red October”, following the unfortunate incident on set where Baldwin unintentionally fired a prop gun, striking Hutchins, the cinematographer, during a rehearsal of a scene in a low-budget western production.
Lawyers for Baldwin claimed that the state acted unprofessionally, citing a set of untested bullets that a potential witness handed to investigators from the sheriff’s office in March. The judge in New Mexico’s 1st Judicial District Court, Mary Marlowe Sommer, expressed strong displeasure over the mishandling of the evidence, which wasn’t shared with Baldwin’s defense team, and consequently threw out the sole charge against him.
In a released statement, lawyers for Alec Baldwin, Luke Nikas and Alex Spiro, expressed that criminal proceedings are intended to seek truth and justice, not for personal or political advantage or to harass the innocent. They claimed that Kari Morrissey and the other defendants repeatedly disregarded this fundamental principle, infringing upon the rights of Alec Baldwin.

The legal team responsible for prosecution has chosen not to challenge a court ruling in New Mexico that dismissed the involuntary manslaughter accusation against Baldwin. Therefore, the controversial case associated with the unfortunate incident is now closed.
The lawsuit stated that even though Sommer dropped the case and strongly criticized the behavior of the local prosecutor and sheriff’s deputies, it was essential to take this action to uphold Baldwin’s rights and discourage the defendants from repeating such actions against others.
In October 2023, it was discovered that Mr. Baldwin planned to initiate a counter-suing civil case. We are eager for our turn in the courtroom.
In March, the armorer from the movie who was originally Hannah Gutierrez, was found guilty by a jury of involuntary manslaughter due to Hutchins’ fatal incident.
