So, Lummis is all about those DeFi protections, but critics are like, “Um, have you read the fine print?”
As the CLARITY Act saunters towards a Senate committee review, the drama is heating up. Are we really sure this bill is the superhero it claims to be for our beloved DeFi developers? Senator Cynthia Lummis seems to think so, but critics are raising their eyebrows and possibly their blood pressure.
Are DeFi Developers Getting the Short End of the Stick as CLARITY Act Moves Forward?
Lummis is not having any of the naysayers’ warnings that the Digital Asset Market Clarity Act might leave decentralized finance developers in hot water. In a statement that could only be described as “passionate,” she pushed back against crypto lawyer Jake Chervinsky, who appears to be waving his legal flag and shouting about dangerous gaps still lurking in the latest draft.

“Don’t believe the FUD,” Lummis declared, because what else would a senator say? She insists that recent bipartisan work has jazzed up Title 3 to make it the “strongest protection for DeFi and developers ever enacted.” No pressure, right? Oh, and by the way, she also thinks passing the CLARITY Act is like flipping the switch for those protections to actually exist.
Chervinsky isn’t just playing devil’s advocate; he’s got a serious beef about how Title 3 defines money transmitters. He’s pointing fingers and saying those definitions might still drag some non-custodial developers into the legal lion’s den, despite another section attempting to play the hero.
Section 604 of the CLARITY Act borrows some fancy language from the Blockchain Regulatory Certainty Act, aka BRCA-because who doesn’t love acronyms? This section says if you don’t control the software and are just providing non-custodial services, you should be safe from the Bank Secrecy Act’s know-your-customer rules.
But hold your horses; Chervinsky thinks that protection might be about as useful as a chocolate teapot if the money transmitter language is still too vague. Someone needs to remind them that clarity is in the name!
“The biggest challenge is ensuring non-custodial software developers aren’t misclassified as money transmitters. That’s non-negotiable for DeFi, and it’s still unsettled,” he said, probably while sipping a coffee and contemplating his life choices.
Chervinsky wasn’t done there.
Lawmakers Focus on Stablecoins While DeFi Questions Hang in the Balance
Meanwhile, this juicy dispute is getting drowned out by another delightful squabble over stablecoin yield and rewards provisions within the same bill. Chervinsky pointed out that these DeFi-related dilemmas are getting the short end of the stick during the latest Washington gossip sessions.
With recent enforcement actions cranking up the urgency, U.S. authorities are on a rampage, pursuing multiple cases against crypto developers. One notable case involved Roman Storm, who apparently thought running an unlicensed money-transmitting business was a great idea. Spoiler alert: it wasn’t.
Lawmakers say the CLARITY Act might be strutting its stuff soon, with a Senate committee review expected in April. But hold on to your hats-updates about DeFi haven’t dropped yet. Stay tuned, folks!
