CFTC Chairman Michael Selig is gearing up for a legal brawl that could make Law & Order look like a tea party. Speaking at Consensus Miami 2026 (because where else would this drama unfold?), Selig declared the agency is ready to throw hands-legally, of course-with states over prediction markets. His warning? This fight might end up on the Supreme Court’s doorstep. Cue the dramatic music.
Selig defended the CFTC’s turf, insisting event-based contracts (think sports and politics) are not just glorified gambling. State gaming regulators, he claims, are trying to treat these federally regulated derivatives like slot machines. “We’re not running a casino here,” Selig quipped, probably while adjusting his superhero cape.
“We expect these matters to go up to the Supreme Court,” Selig said during a fireside chat, presumably while roasting marshmallows of justice. The CFTC has already sued states like Arizona, Connecticut, Illinois, and New York-because nothing says “federal authority” like a good old-fashioned lawsuit.
Prediction Markets: Not Just a Vegas Fling, Says Selig
Selig drew a line in the sand between regulated event contracts and casino bets. “When you walk into a casino, you’re basically handing money to a bookie,” he explained. “But with event contracts, you’re trading on federally regulated exchanges. It’s like comparing a spreadsheet to a Ouija board.”
He added that event-contract traders can sell their positions before settlement, unlike casino-goers who are stuck with their bets. “It’s finance, not fate,” Selig joked.
States: The CFTC’s New Frenemies
Selig accused state gaming commissions of trying to protect their gambling monopolies by targeting federally registered exchanges. “They’re like the cool kids who don’t want anyone else in the club,” he said, probably rolling his eyes.
The CFTC has sued “five or six states” (because who’s counting?) and plans to keep filing lawsuits whenever states step on federal toes. “We’re not here to play nice,” Selig declared, channeling his inner Bridget Jones’s boss.
Crypto Rules: Harder to Undo Than a Bad Tattoo
Selig also hyped the SEC-CFTC crypto taxonomy as a game-changer for digital asset regulation. “For so long, crypto folks have been afraid to build in the U.S.,” he said. “Now, we’re giving them clarity-and it’s harder to undo than a joint rulemaking.”
He compared it to a bad tattoo: “Once it’s there, it’s there. Unless you get laser removal, which in this case would require both agencies to agree.”
Wallet Developers: Breathe Easy (For Now)
Selig gave a shoutout to Phantom Technologies, whose self-custodial wallet software won’t be treated as a broker. “We’re not here to regulate every software developer like they’re a Wall Street titan,” he said. “Unless they start acting like one.”
He added that self-custodial wallets could soon connect directly to regulated derivatives exchanges. “It’s like DeFi’s coming-out party,” Selig quipped.
CFTC’s AI: Not Skynet, Just Market Surveillance
Selig revealed the CFTC is using AI to monitor markets, because “we can’t be Luddites in a tech-driven world.” But don’t worry, he assured, “AI won’t replace human oversight. We still need our quants and exchanges to flag the weird stuff.”
One-Man Show: Selig’s Solo Act
Addressing his status as the CFTC’s lone commissioner, Selig said, “The show must go on. I’m like a one-man band, but with more paperwork.” He insisted the agency won’t slow down, citing progress on the GENIUS Act and the upcoming CLARITY Act. “I’m not hitting pause,” he declared, probably while juggling legislative briefs.
