For five seasons, Kevin Spacey starred as the ruthless politician Frank Underwood in the Netflix series House of Cards. However, after allegations surfaced, he was replaced by Robin Wright, who played his wife Claire, for the show’s sixth and final season. The production company, Media Rights Capital (MRC), had already filmed some episodes with Spacey when they decided to remove him, leading to costly rewrites and reshoots.
These events unfolded while Kevin Spacey faced accusations of sexual assault, beginning with claims from Anthony Rapp and others. Many believed Netflix and MRC ended their relationship with him due to the negative publicity. MRC supported this idea when they pursued arbitration against Spacey in 2019, alleging he broke his contract by violating their anti-harassment rules. The court ultimately ruled that Spacey was responsible for nearly $31 million in production expenses.
Eventually, MRC and Spacey reached a deal: Spacey would pay MRC $1 million, but in return, Spacey would assist MRC in pursuing legal action against Fireman’s Fund Insurance Co., which had insured the production of House of Cards. MRC appears to be shifting its legal approach in the case against Fireman’s Fund. According to The Hollywood Reporter, MRC is no longer arguing that Spacey’s involvement in season 6 of House of Cards was due to him violating the contract’s anti-harassment policies. Instead, they are now claiming it was due to his personal issues, specifically sex addiction.
The insurance policy stated that Fireman’s Fund would cover MRC’s production losses only if those losses were directly caused by Kevin Spacey’s illness. However, Fireman’s Fund claims MRC actually ended its relationship with Spacey due to his inappropriate behavior and the resulting negative publicity. Now, a jury must decide which argument is correct. If the jury sides with MRC, Fireman’s Fund could be required to pay the production company over $100 million.

This is the third attempt by MRC to recover production losses from Firefund’s Fund, and the judge has warned it will be their last. MRC needs this attempt to succeed if they want to be paid. The key to their current strategy is Kevin Spacey’s cooperation. He’s agreed to provide medical records and a statement claiming he considered suicide if forced to return for a final season of the show. In court, he’s expected to testify that his health issues required ongoing treatment – he entered a rehab facility in Arizona on November 2, 2017, shortly after allegations of sexual assault surfaced – and that he was unable to work at the time, regardless of any previous statements he may have made.

However, Fireman’s Fund argues MRC replaced Spacey to avoid negative publicity, something the policy doesn’t cover. The situation is complicated by the fact that Netflix also canceled several Spacey projects around the same time, even completed ones like the Gore Vidal biopic, Gore. A jury might question why Netflix would remove a finished film starring Spacey unless it was concerned about bad press, since his personal issues hadn’t prevented its completion. However, the decisions surrounding Gore and House of Cards may be considered separately, as they were different projects.
