This paper, ‘From Chat Control to Robot Control: The Backdoors Left Open for the Sake of Safety’, examines how the European Union’s proposed Chat Control regulation – designed to detect and prevent online child sexual abuse material – could extend surveillance into the rapidly evolving field of human-robot interaction. We argue that applying these content-scanning protocols to social robots – increasingly deployed in care, education, and companionship roles – risks transforming these devices into monitoring mechanisms, eroding user privacy and trust. As robots gather and process increasingly personal information – voice data, behavioral patterns, even emotional cues – the need for robust safety protocols and ethical guidelines becomes paramount, demanding a proactive approach to regulation before these technologies become ubiquitous and potential harms are realized.

The European Union’s efforts to safeguard online spaces through the proposed Chat Control Law are poised to significantly impact the burgeoning field of robotics. Initially intended to detect and prevent online abuse, the legislation’s broad definition of Interpersonal Communication Services (ICS) inadvertently includes interactions with robots. This means that communications to and from increasingly sophisticated robotic companions – including those offering assistance, education, or simply companionship – could be subject to scanning for prohibited content. While proponents emphasize child safety as a primary goal, the application of such regulations to robotic interactions raises concerns about data privacy, freedom of expression, and the potential for transforming assistive technologies into tools for passive surveillance, demanding careful consideration of the law’s scope and implementation.

Prioritizing privacy-preserving technologies, such as federated learning and differential privacy, isn’t simply a matter of compliance, but a foundational requirement for building user trust and sustaining long-term adoption. Without proactive security measures embedded directly into system design – an ‘ambient regulation’ approach – there is a demonstrable risk of eroding user agency and fostering justifiable skepticism. Recent demonstrations highlight how easily these robots can be exploited to collect sensitive data or manipulate user behavior, underscoring the urgent need to safeguard fundamental rights as these technologies become more integrated into daily life. Successfully navigating this challenge requires a paradigm shift towards building robots that are not only intelligent and capable, but also demonstrably respectful of privacy and autonomy.

The field must now confront the limitations of current risk assessment frameworks, which tend to prioritize immediate threats over long-term erosions of privacy and autonomy.
