Marilyn Chinitz, a partner at Blank Rome LLP in matrimonial matters, shared with People on Wednesday: “She probably felt the need to finalize things quickly. There were many moments of indecision and hesitation, and this action signifies ‘I am progressing, I’m filing for divorce and doing it independently.'”
Moreover, the legal advisor mentioned their assumption that the ex-power pair might be collaborating with a neutral third party for mediation purposes.
Chinitz isn’t involved in the matter, yet she feels the action was taken to demonstrate her readiness to take new steps forward.
“She seems to be indicating that she intends to proceed with filing, regardless of whether she seeks advice from a lawyer or not.”
In terms of the claim that they didn’t have a prenuptial agreement, it’s quite uncommon, almost unexpected, according to the legal expert’s perspective.
In simpler terms, Chinitz mentioned that people usually don’t create prenuptial agreements if they have already placed most of their possessions into a trust for their kids, and these trusts have already been set up so that those assets won’t be considered shared property in case of marriage.
The attorney noted that the nature of the divorce, whether it remains friendly or not, could be influenced significantly by Ben’s upcoming public actions.

After each of them married different individuals – she tied the knot with Mac Anthony in 2004 and he wed Jennifer Garner in 2005 – they later separated from their spouses and eventually rekindled their relationship.

She listed the date of separation as April 26, 2024, as per legal docs seen by DailyMail.com.

The movie chronicles the process of creating her newest album, titled “This Is Me… Now”, a significant portion of which was motivated by her relationship with Ben.
In a particular scene from the film, Ben expressed surprise when he discovered his private love letters, which Jennifer Lopez had provided for their musical inspiration in her upcoming album, were being sifted through by her bandmates.
During his 13-year marriage to Garner, the actor held onto his communication with the singer. Later, he compiled those letters and emails into a book as a gift for her upon their reunion in 2021.
He told the camera: ‘Things that are private I always felt are sacred and special because, in part, they’re private.’
Earlier this year, when asked by Variety if they might act together again in a film, Lopez replied, “Perhaps, given the right project.”

On Tuesday morning, Ben was spotted with his former spouse, Jennifer Garner, and their son, Fin. They had just dropped off their oldest child, Violet (aged 18), at college.
Hours later Lopez filed for divorce. It was her two year wedding anniversary with him.
