As a fan who has been enthralled by Gotham’s gritty underbelly for years now, I must say that “The Penguin” episode 7, “Top Hat,” was a masterful blend of suspense and heartbreak. The revelation of how Oz’s brothers, Jack and Benny, met their untimely end was not just a chilling moment, but a poignant reminder of the ripple effects of our actions.

In episode 7 of “The Penguin,” titled “Top Hat,” we’ve long anticipated an answer was revealed: the fate of Oz’s brothers, Jack and Benny. Unlike a casual mention or passing remark to Vic in the present, this revelation was delivered through captivating flashback sequences. These sequences transported us back to Gotham during the ’80s, immersing us in the events that led to their demise within the broader context of the crime drama.
During that period in their lives, their mother Francis was managing the finances for Rex Calebrese, a local gangster who was well-respected by Oz. On this ordinary afternoon, the boys, including themselves, wished to spend quality time with their mom while they played around. Despite being occasionally disturbed by their antics, Francis remained affectionate towards Jack and Benny. However, she asked Jack to take the others out so she could complete her tasks. Additionally, she handed over Rex’s financial records to Jack.
Prior to taking any action, Jack had to hand over the ledger to Rex. He’d cautioned his brothers about the man, but it was evident that Oz admired the gangster from the start. Despite being children, they left to play and, as Oz mentioned to Vic in episode 5, they did so in the deserted tunnels below ground. However, none of the Cobb boys were aware that only Oz would return home to their mother.
How did Jack and Benny die on The Penguin?
One of Benny’s preferred pastimes was engaging in a game of flashlight tag. It was Oz who was designated as “It” first among the trio, even though he didn’t properly count up to ten according to the rules. However, this didn’t matter much because his brothers opted to modify the game’s structure. The revised rule allowed them to conceal themselves not just in the station but deeper into the tunnels and what appeared to be an urban sewer network.
Oz tried to get down there with them but he couldn’t with his leg brace. It’s hard for him to go down the ladder to the part of the tunnels they were in on a good day, but that day it was raining. Frustrated and mad at his siblings, he decided he wasn’t going to play anymore. And, as payback, he closed the door to the shaft they’d gone down. What he didn’t know is that his brothers wouldn’t be able to open it. Oz went back home and got time with their mom by himself like he’d wanted not realizing the severe consequences of his actions.
A heavy storm flooded Gotham, bringing torrential rain. When Jack and Benny were in a tunnel, it started filling with water due to Oz closing the door. Initially, there was no immediate cause for worry, but the continuous rain kept forcing more water into the tunnels. The brothers attempted to escape, calling out for help, yet their cries went unheard. Eventually, the water level became so high that they drowned.
Francis may not know how her sons died which is the advantage Sofia needs
In the movie “Top Hat,” it appears that Oz may not have disclosed the truth about his brothers’ fate to Francis. On the night they perished, he claimed they had gone to the cinema and returned to be with her – this scenario seems implausible if he indeed played a role in their demise. His guilt over the tragic loss of his brothers could account for his complex relationship with his mother and his persistent desire to make her proud by any means necessary.
If Francis isn’t aware of Sofia’s plans, it leaves her vulnerable for manipulation. The matriarch of the Gigante family found herself driven by a desire to play different strategies due to the biased system she was born into, which favored men. It appeared as though Julian, the psychiatrist, was assigned the role of exploring Francis’ past memories in search of the truth behind Jack and Benny’s disappearance.
By the end of “Top Hat,” she took the woman to Monroe’s, the jazz club where Oz shared with Sofia that his mother had taken him after making a decision to leave her bed following the death of her sons. In the final scene, The Penguin is about to fulfill the promise Oz made to Francis that fateful night, which could help clarify it for her as well.
Sofia expressed her desire for her enemy to experience genuine suffering. The revelation that he was accountable for his brothers’ demise, and that their lives were drastically altered due to a decision he made, could inflict this pain instantly. This would be particularly effective if it provoked Francis, causing any remaining pride in him to vanish and be replaced with shock, disgust, and animosity.
It seemed like Oz planned to deceive Sofia into thinking he was giving her control of the underworld, but it appears she has no intention of merely taking the keys; instead, she aims to use them against him and potentially defeat him. The final chapter will decide who emerges victorious.
