Sexual-assault lawsuit against James Dolan, Harvey Weinstein tossed in California
As a seasoned cinephile who has witnessed the rise and fall of countless Hollywood heavyweights, I must say this latest turn of events surrounding Harvey Weinstein leaves me both saddened and perplexed. The dismissal of the sex trafficking lawsuit against James L. Dolan and Weinstein feels like yet another twist in a tale that refuses to adhere to any semblance of logic or justice.
In simpler terms, a U.S. court judge has thrown out a case that claimed the CEO of Madison Square Garden, James L. Dolan, along with disgraced filmmaker Harvey Weinstein, were involved in acts of sex trafficking and sexual misconduct.
On Tuesday, Judge Percy Anderson dismissed the case in the U.S. District Court for Central California.
The legal action initiated in January claimed that Dolan had deceived 27-year-old massage therapist Kellye Croft, leading her to LA on false promises. This was allegedly done so that Dolan could perform illegal and discomforting sexual acts against her consent.
The complaint also accused Weinstein of sexually assaulting Croft, alleging that Dolan, 69, knew about and funded the abuse through his corporate entities, including some connected to music executive Irving Azoff.
Croft’s lawyers, Kevin Mintzer and Meredith Fireto, stated that they politely oppose the District Court’s judgment, as they think it misconstrues the federal sex trafficking law and weakens vital safeguards for victims of sex trafficking. They announced their intention to appeal this verdict, expressing faith that the Court of Appeals will rectify this injustice.
A representative from Dolan praised the court’s decision, describing the lawsuit as a cruel and manipulative tactic used by an attorney seeking to exploit the legal system for their own advantage, by making baseless, horrible claims.
A representative from Weinstein’s team also refuted the accusations when they were initially made. Regarding Azoff, mentioned neither in the lawsuit, his personal representatives have stated that neither he nor his organizations had any part in any alleged wrongdoings by others.
72-year-old Weinstein is currently incarcerated, serving a 16-year term due to a 2013 rape conviction at a Beverly Hills hotel. He is presently detained in New York, awaiting another trial for rape charges.
In 2020, I found myself facing a 23-year prison sentence in New York, not for any artistic mishap on the sets of “Shakespeare in Love” or “Pulp Fiction,” but due to charges related to assaulting former production assistant Mimi Haley and once-aspiring actress Jessica Mann. However, in April, following my appeal, that conviction was overturned.
As a passionate movie enthusiast, I can’t help but express my disapproval when I see a turn of events that goes against justice. Recently, the reversal in question has stirred up quite a storm among public figures, Weinstein accusers, and their allies, including California Governor Gavin Newsom. Together, we stand united in our condemnation of this decision.
Though these victims may feel defeated in this particular instance, their fight is far from over,” Gloria Allred, Haley’s lawyer, stated. She described the NY court’s decision as a setback for the ‘Me Too’ movement, emphasizing that it represents a step backward in its progression.
Harvey Weinstein reiterated his innocence and entered a “not guilty” plea on Wednesday regarding a newly-filed sex crime charge in New York. The specifics of this new accusation have yet to be disclosed, as reported by the Associated Press.
This month, Weinstein was urgently taken to Bellevue Hospital in New York for a heart operation and treatment for multiple health problems, as stated by his spokespeople. By September 9th, they reported that the ex-entertainment magnate had successfully undergone surgery and was in the process of recovering.
