Nick Carter faces 4th sexual assault lawsuit: Accuser says alleged rape led to HPV, cancer
Originally, the Backstreet Boys band member Nick Carter is being accused of a fresh rape allegation, coming on top of three previous lawsuits involving sexual misconduct claims against him.
A new accuser, Lauren Penly, has stepped forward with troubling claims against the 45-year-old pop star. She alleges that he raped her on two occasions in 2005 and gave her sexually transmitted diseases, one of which eventually led to a cervical cancer diagnosis. Penly filed her lawsuit recently in Clark County, Nevada. The lawsuit, reviewed by The Times, states that she had a short, “intimate” relationship with the star from December 2004 to February 2005 when she was just 19 years old.
In this lawsuit, Penly accuses Carter of three offenses: sexual assault, causing emotional distress intentionally, and negligently inflicting emotional distress. Penly demands compensation amounting to at least $15,000 for both past and future medical costs as well as pain and suffering, along with legal fees and extra damages. A jury trial is what she’s asking for.

A third sexual assault claim has been brought against Nick Carter, with the accuser stating that the musician inappropriately approached her when she was a teenager, at the height of his popularity with the Backstreet Boys.
Attorney Gianna N. Elliot, speaking on behalf of Penly, stated on Wednesday, “It requires deep courage and strength for survivors of sexual assault to step forward publicly in the quest for justice, especially in the music industry, which has historically encouraged an environment rife with sexual misconduct.
On Wednesday, Carter’s legal representative did not promptly respond to The Times’ request for a comment, but later issued a statement through various media outlets, refuting Penly’s claims. The singer’s legal team stated that Carter does not remember ever encountering his latest accuser at all, let alone engaging in any interaction or relationship with her.
Over a claimed duration of several months, Penly traveled to Los Angeles to visit Carter (brother of the late teen star Aaron Carter), and they had consensual sexual encounters on three separate occasions. This is detailed in a 10-page complaint. It was asserted by Penly that she had never engaged in unprotected sex before her relationship with Carter, but alleged that the singer refused to use any protection and made her think he was free of sexually transmitted diseases.
As per the court case, it is claimed that in early 2005, Carter forced himself upon Penly. Penly stated that she visited Carter’s apartment with the intention of merely watching a film and spending time together, not for any sexual activity. However, Carter reportedly rejected this proposal, stating that the only purpose of her presence was sex, which is what she desired. The lawsuit alleges that Carter then picked up his accuser and violently threw her onto his bed before bending her over the side of the bed and brutally raping her, despite her repeated cries of “no.

Music
A female individual has initiated a legal action, alleging that Nick Carter subjected her to sexual misconduct following a Backstreet Boys concert in Washington D.C., back in 2001.
The allegation asserts that Carter instructed Penly to conceal the incident of alleged sexual assault, implying that no one would trust her account.
Two months following the contested event, Carter extended an apology to Penly and invited her to his apartment. Upon her arrival, Carter was accompanied by two companions whom he informed would be momentarily absent, as he guided Penly towards his bedroom, according to the lawsuit. Penly allegedly expressed to Carter, as stated in the lawsuit, that she did not wish to engage in sexual activity. However, the singer is said to have forcefully continued the act despite her repeated denials and demands for him to cease. The lawsuit further claims that Carter intentionally carried on with sexual intercourse with Penly despite her clear refusals.
Previously, Penly claimed that Carter had given her multiple sexually transmitted infections, among them the Human Papillomavirus (HPV), which she attributed as the cause of her cervical cancer diagnosis.
In July 2005, according to the lawsuit, Penly found out from her physician that she had contracted both chlamydia and gonorrhea. The suit also mentions that she tested positive for abnormal cells, as per the claim. As suggested by the Mayo Clinic, certain strains of HPV can lead to various types of cancer, including cervical cancer. A month following her STD diagnosis, Penly was diagnosed with Stage 2 cervical cancer and underwent multiple treatments that included a comprehensive cervical operation, as stated in the lawsuit.
Additionally, Penly claims in her court case that she continues to experience harassment from admirers of the Backstreet Boys following her involvement in a deposition concerning other women who accuse Carter of sexual misconduct.

Lawyers for Nick Carter are challenging the ‘extraordinary accusations’ presented in the ‘Nick and Aaron Carter: Fallen Idols’ documentary series, focusing on the three instances of sexual misconduct claims leveled against the artist.
According to the lawsuit, the consequences of Carter’s sexual assaults remain persistent, leading the Plaintiff to experience intense emotional turmoil, physical pain, health problems, difficulties with intimacy, and various complex traumas.
In Penly’s ongoing lawsuit, there are striking similarities to a string of lawsuits filed over the past few years against Nick Carter, a member of the Backstreet Boys. A woman sued him in 2022, claiming he had sexually assaulted her when she was 17 and passed on HPV. Another woman followed with a lawsuit in August 2023, making similar allegations. In 2017, a singer from the girl group Dream also filed a lawsuit against Carter, accusing him of rape from the early 2000s. These three accusers shared their stories in the 2024 docuseries “Fallen Idols: Nick and Aaron Carter.
According to People, Nick Carter’s lawyers, Liane K. Wakayama and Dale Hayes Jr., have discarded the allegations as “simply more baseless claims from the group of conspirators and their legal team, who persistently misuse the judicial system in an attempt to tarnish Nick Carter’s reputation.
The lawyers stated: ‘They follow the same old pattern – bide their time for decades, waiting until Mr. Carter achieves a career achievement. Then, using the protection of litigation, they make baseless accusations designed to cause the greatest harm to Nick and his loved ones.’
Previously, Penelope (Penly) initiated her legal action, while Carter is currently promoting fresh tunes and featuring in the recently unveiled Paramount+ two-part series titled “The Carters: Hurts to Love You.” This documentary debuted on Tuesday. Meanwhile, the Backstreet Boys are gearing up for a residency at the Las Vegas Sphere, set to commence in July.
