With Kyle Sandilands‘ $88 million lawsuit against the Australian Radio Network (ARN) moving forward in Federal Court, more information about his side of the case is now becoming public.
On Thursday morning, 2GB breakfast show host Ben Fordham stated that the radio personality would likely claim any controversial statements were simply mistakes made while rushing to meet deadlines.
Fordham explained that Kyle Sandilands’ radio show with Jackie O had a 30-second delay, and the station had hired a censor due to previous violations of broadcasting rules.
The team worked for the radio station, not directly with the Kyle & Jackie O show. A censor would cut off any potentially inappropriate content with a beep.
Fordham explained that when Sandilands had his well-known on-air disagreement in February, the broadcast censor didn’t stop it from being aired.
Fordham stated he believes Kyle’s contract specifies the radio station is accountable for all broadcast content.
Fordham explained the issue was more serious than it appeared, and stated that ARN was responsible for ensuring Sandilands didnāt violate the terms of his ten-year contract by publishing or broadcasting anything problematic.
According to sources, the radio station has to remove any content that violates the agreement between ARN and Kyle.
If the radio station aired anything that violated Kyle’s contract, they were obligated to stop broadcasting it.
The broadcaster also mentioned that a past dispute between Sandilands and Henderson, which occurred in 2025, would likely be a key part of Sandilandsā defense.
The argument wasn’t immediately public, but it eventually came to light on the Kyle & Jackie O radio show when they were speaking with relationship expert Melissa Ferrari.
In the recording, Kyle seems to be teasing Jackie, accusing her of being distracted and prioritizing personal calls over her work.
The back-and-forth culminated in Henderson storming out of the studio.Ā Ā
‘Okay, I’m going!’ Jackie raged.
‘I’m constantly getting f***ing gaslit around here!’ she added before leaving the studio.
Fordham explained that this incident would support Sandilands’ case, as it shared parallels with the previous conflict that led to both his and Henderson’s dismissal.
He explained that Kyle accused Jackie of being out of touch with reality back then, and he made the same accusation again this year.
You know, I’ve been hearing whispers in the industry for a while now, and it seems like everyone’s been aware that Jackie wasn’t fully focused for a couple of years. Kyle actually pointed this out back in 2025, and honestly, it’s still the same story he’s telling us today.
Fordham pointed out that Jackie O reported feeling bullied and manipulated back in 2025, but ARN didn’t investigate the claims at that time.
‘In fact, the fight was packaged up and used for a future segment. They didn’t want to waste it.
Kyle Sandilands is arguing that if his actions weren’t considered problematic enough to warrant punishment in 2025, it’s unfair to fire him for doing the same thing in 2026.

Last Wednesday, Kyle Sandilands revealed that his radio show, Kyle & Jackie O, had been cancelled. ARN, the company that owns KIIS FM, ended his ten-year contract, which was worth $100 million.
According to a source who spoke to news.com.au on Monday, Kyle Sandilands plans to argue in his defense that ARN management never cautioned him about his interactions with his co-host.

The report states that Sandilands and his lawyers are reviewing recordings of The Kyle and Jackie O Show to demonstrate that arguments between the hosts were commonplace.
A source shared that Sandilands is regularly submitting invoices to ARN, claiming his dismissal was unfair and taken advantage of.
On Monday, ARN released a statement saying they disagree with Kyle Sandilands’ allegations and intend to fight the legal case.
The applicants are arguing that the decision to end Mr. Sandilandsā contract was unlawful. They claim he didnāt do anything seriously wrong or break his contract, and that ending the contract was unfair and violated Australian Consumer Law, according to their statement.
The people applying to the court are asking the judge to enforce two contracts, order payment of any outstanding balances owed under those contracts as of the courtās decision, and award them financial compensation for any losses.
