Kevin Costner sued by ‘Horizon’ Chapter 2 stunt performer over unscripted rape scene
An acrobat is taking legal action against Kevin Costner, Horizon Series Inc., and Territory Pictures Production Company, alleging that they forced her into an unexpected, unplanned sexual assault scene during filming, without prior warning or the presence of an intimacy supervisor.
Costner’s attorney called the lawsuit a “shakedown.”

Following the lackluster performance of ‘Chapter 1’ at the cinema, the planned release date for the sequel of Kevin Costner’s grand Western tale has been postponed.
The sudden job requirement significantly impacted stunt performer Devyn LaBella, as stated in the lawsuit. This impact wasn’t just about disrupting a career she had carefully constructed over many years, but also resulted in lasting trauma that she will need to manage for an extended period.
In this lawsuit filed in LA, I’m at the center of claims that, after performing a rehearsed rape scene as a stunt double for Ella Hunt, the next day Costner added an unscheduled, unscripted rape scene with another actor.)
In the heart of the predicament, I found myself trapped, with little option but to bide my time until the horror passed, as stated in the legal document.
Kevin Costner’s attorney, Martin Singer, stated on Wednesday that Costner is always committed to ensuring a comfortable and safe work environment on film sets. However, Devyn LaBella’s claim against him lacks any credibility, as it directly contradicts her own behavior and the facts. Singer expressed confidence that Costner will ultimately prove this to be true.

Television
According to reports, Kevin Costner has stated definitively that he will not reprise his role in Paramount’s ‘Yellowstone.’ He mentioned that this popular show had a profound impact on him, as it represented something that truly altered him.
In April and May of 2023, the film’s singer labeled LaBella as a repeated accuser in the entertainment world, and claimed that she and her legal team employed “extortionate tactics,” also known as “shakedown strategies.
In the role of a stunt artist on Horizon 2, the specific scene was outlined to Ms. LaBella. Following a rehearsal where she acted out the scene alongside another performer, she signaled her readiness to film it, should it be required (even though it wasn’t necessary). She gave this signal by giving a ‘thumbs up’ to her Stunt Coordinator supervisor.
Additionally, Singer shared a text message from LaBella to stunt coordinator Wade Allen following the completion of their film work. In the message, LaBella expressed her gratitude as follows: “Thank you for these fantastic weeks! I truly appreciate you! I’ve learned so much and thank you again.” She also added that she was really pleased with how things turned out and wished him well during the remainder of the shoot, promising to talk soon.
On Wednesday, a spokesperson for LaBella declined to provide an immediate comment when approached by The Times.

Entertainment & Arts
In a recent chat, Kevin Costner shared that he decided to have his 15-year-old son Hayes join the cast of ‘Horizon: An American Saga’ as it gave him an opportunity to spend time together on set, stating, “I couldn’t resist having him by my side.
The legal action alleges that Costner has been involved with acts of sexual discrimination, sexual misconduct, fostering a toxic work atmosphere, retaliation, violating contractual obligations, among other claims.
In the lawsuit, it’s stated that during an unexpected rape scene, no intimacy advisor was present, contrary to what LaBella anticipated as he was supposed to stand-in for Hunt in a non-intimate scene instead.
According to the lawsuit, it’s stated that LaBella wasn’t informed prior that Hunt had declined to participate in the scene and left the set. Moreover, she wasn’t alerted or prepared for her scene partner, Roger Ivens, to perform or act inappropriately towards her. It was only when Ivens was already on top of her doing so that LaBella discovered he would mount her and forcefully lift her skirt up.
During the filming process, LaBella found it difficult to discern when specific actions were taking place and was not given any opportunity to approve or decline Costner’s instructions for the scene, according to the lawsuit. On breaks between takes, Ivens reportedly positioned himself next to LaBella, lying on his side with his hand placed near her vagina, as stated in the court documents.

According to the lawsuit, after rehearsing a second rape scene, LaBella often cried and eventually left Utah for Los Angeles for a short while to recover. When she went back to work, the legal document claims that the production team became more cautious around her, instructed her to stay isolated in her trailer, and keep away from the set. This only increased her unease.
Back in June 2023, I found myself embarking on a journey of healing, following an incredibly harrowing experience. The therapy sessions I attended helped me confront and manage “unwanted, haunting recollections of the traumatic incident, sleepless nights, apprehensions towards intimacy, and persistent anxiety.” It’s been a challenging road, but I’m determined to conquer these hurdles.
As a devoted fan, I’ve noticed that since the second installment of “Horizon,” LaBella alleges in her lawsuit that Allen hasn’t given me an opportunity to work on any project. My IMDb profile doesn’t show any projects following “Horizon: An American Saga,” a four-part endeavor by Costner, which seems to be struggling after the first movie underperformed at the box office. Regrettably, the second chapter was removed from its planned August 2024 theatrical release and has only been screened at two film festivals.
It’s uncertain if Hunt’s character features in the third chapter of “Horizon: An American Saga,” as IMDbPro indicates that Hunt is not credited as a cast member for the film which started production in May 2024. Allen, known for his roles in “Landman” and “Lioness,” is not listed as the stunt coordinator either. However, it seems that the final list of actors and crew might be incomplete at this stage.

50 Cent was given approval by a judge to take possession of a previous executive’s house as part of an agreement stemming from allegations of embezzlement in connection with his cognac and champagne business, Sire Spirits.
As a once aspiring gymnast turned stunt performer, I’ve had the privilege to showcase my skills in various projects, such as the “Barbie” film and the hit streaming series “Yellowjackets.” Since my involvement in the second installment of “Horizon,” I’ve added credits for episodes of “NCIS” and the movie “Beverly Hills Cop: Axel F.” to my resume.
The legal action aims to recover both compensatory and penalty damages, with the exact amounts yet to be decided in court, as well as covering related costs and attorney fees. Furthermore, it requests that the defendants undergo anti-sexual harassment and anti-sexual violence training from a trusted organization, and extend an apology to LaBella.
