Kevin Costner Faces Lawsuit Over Shocking Unscripted Scene in Horizon 2

Kevin Costner and the team behind “Horizon: An American Saga – Chapter 2” are facing a lawsuit by a stunt artist over an impromptu sex scene during filming. A while ago, Costner announced the development of the “Horizon” series, a collection of Western movies. The initial plan was to release the first two films about two months apart last summer. However, due to poor box office performance, “Horizon: An American Saga – Chapter 1” was delayed until late June, and as a result, the distributor removed “Horizon: An American Saga – Chapter 2” from its scheduled release.

According to The Hollywood Reporter, it has been disclosed that a significant controversy surrounding the set of Horizon 2 originated from a stunt performer filing a lawsuit. Devyn LaBella alleges that in May 2023, she was unexpectedly required to film an unscripted and graphic rape scene without adequate warning. Furthermore, she asserts that her consent was not obtained, and claims that the Horizon 2 set lacked an intimacy coordinator on duty, contrary to the contractual agreement. LaBella is currently taking legal action against Costner and the production companies for alleged incidents of sexual discrimination, harassment, and the establishment of a hostile work environment. That day, I felt incredibly vulnerable, without any shield or support, and profoundly deceived by a system that guaranteed security and expertise. The incident left an indelible mark on me, causing a fundamental shift in the way I navigate this field.

In opposition to LaBella’s statement, Costner’s attorney, Marty Singer, said the following:

Costner consistently prioritizes comfort and safety for everyone involved in his film productions. The allegations made in this lawsuit are baseless and directly opposed to LaBella’s own behavior, as well as the concrete facts of the situation.

What This Means For The Horizon Movies

This Is Not The First Legal Battle Horizon Has Faced

Previously, the Horizon film series has encountered legal issues before. Just this month, New Line Cinema initiated an arbitration lawsuit against Kevin Costner and his business entity. They asserted that the Horizon team violated their financing agreement terms. In a complex loan scenario, City National Bank had already filed arbitration suits against both New Line and the Horizon Series. However, New Line retaliated with a counterclaim against Costner’s company, alleging that they failed to meet their financial obligations. The LaBella claims further escalate this legal conflict.

Regarding this recent allegation, it’s stated that LaBella was employed as a stunt performer for actress Ella Hunt, whose part included a compulsory intimacy coordinator. The lawsuit mentions that following discussions, Hunt’s agreement required an intimacy coordinator in all nude or intimate scenes. In principle, it would seem reasonable that these requirements should have extended to LaBella, given her role as Hunt’s stunt double. However, on one occasion, an intimacy coordinator was present, and everything was carried out appropriately. Yet, the following day, when non-intimate scenes were planned, LaBella discovered that Costner had inserted a sudden, unplanned, sexually violent scene with another actor, without involving the intimacy team.

This Is Troubling In The Ongoing Intimacy Coordinator Conversation

Though Costner’s team might refute LaBella’s allegation, the details of her lawsuit are troubling given the ongoing discussion about intimacy coordinators. In the past, having an intimacy coordinator was uncommon on film sets. Shows like “Sex Education” have worked to correct these past issues and make intimacy coordination more standard in the industry, but this change hasn’t come without controversy as actors, directors, and others have differing views on their importance. In light of this discussion, however, it seems inappropriate that Horizon failed to have an intimacy coordinator present during such an intense scene.
