The outing refers to a court hearing that is taking place, following a request made by a state attorney for a New Mexico judge to rethink their decision to dismiss the involuntary manslaughter charge against Alec, in relation to the fatal shooting of cinematographer Halyna Hutchins on the set of Rust in 2021. This information was disclosed in court documents made public on Wednesday

As a die-hard admirer of truth and justice, I can’t help but echo the sentiments of Special Prosecutor Kari Morrissey. The July decision, in my view, seemed to be missing a strong factual foundation. Furthermore, it didn’t appear to encroach on the due process rights of the esteemed Mr. Baldwin, and that’s something I find crucial in upholding our legal system’s integrity

Previously, District Court Judge Mary Marlowe Sommer halted the trial prematurely, arguing that crucial evidence regarding the fatal shooting of Hutchins was not disclosed to Baldwin’s legal team by the police and prosecutors

The dismissal was made with prejudice, preventing the charge from being refiled once any potential appeals are resolved. 

In the course of rehearsal for the film Rust, Baldwin – the principal actor – accidentally fired a gun, which tragically struck and killed the cinematographer, Halyna Hutchins, and wounded the director, Joel Souza

30 Rock’s famous actor asserted that he cocked the gun but didn’t fire it; instead, the revolver discharged on its own

The situation centered around some ammo, which was delivered to the sheriff’s office in March by an individual who asserted that it could potentially be connected to Hutchins’ demise

In a twist of events, prosecutors deemed the ammunition insignificant, whereas Baldwin’s legal team alleged they were withholding it. This allegation resulted in a successful request to drop the case

In her plea for a second look, the special prosecutor, Morrissey, contended that the hidden ammunition wasn’t significant and instead emphasized Baldwin’s duty to adhere to firearm safety regulations

In the prosecution team’s actions, there was never an intentional withholding of evidence from the defendant. It wasn’t that the prosecution thought of the bullets as being important to the case; rather, they failed to recognize that these rounds were similar to the live rounds found on the Rust movie set, even though they were. [This is according to Morrissey’s court document writings.]

She asserted that the defense lawyers knew about the ammo but decided not to inspect it prior to the court case

‘This is a smoke screen created by the defense and was intended to sway and confuse the court … and it was successful,’ Morrissey wrote. 

Baldwin’s attorney, Luke Nikas, stated that a response will be submitted to the court.

This April, Hannah Guttierez-Reed, the set’s armorer, was found guilty of involuntary manslaughter in connection with Hutchins’s death and received a sentence of 18 months

At present, she is incarcerated at the Santa Fe County Adult Detention Center, where she was expected to take the witness stand in the trial of Baldwin’s case

Following the 2021 shooting incident, filming for Rust resumed in Montana, following a production deal with Matthew Hutchins, who became an executive producer under the arrangement, due to his wife’s involvement

The completed movie has not yet been released for public viewing.
