However, just this month, the actress applied for sole custody of their son, Maceo, alleging that her ex-partner has failed to be an active and involved co-parent, and has declined to participate in joint decision-making concerning their son, as stated in court documents obtained by The Times.

In two recent submissions, Martinez contends that his ex-spouse concocted a distorted account to limit his involvement in shared parenting. He also pleads with the court to delay a custody hearing set for September 10th, providing him ample opportunity to refute her allegations against him – primarily that he is unreasonably obstinate and has failed to attend compulsory co-parenting counseling sessions.

In my perspective, Martinez asserted in his double submissions that his former spouse was trying to medicate our son psychotropically without my consent. However, Berry refuted this, stating it was impossible because for more than a year, Olivier has hindered Halle from even getting an evaluation necessary for any recommendation to be made.

In the document she submitted, Berry stated that his statement suggests he is either unaware of Maceo’s difficulties or chooses to ignore them carelessly – regardless of the reason, it underscores why he should not be allowed to take decisions concerning this child.

In her previous submission dated August 16th, Berry additionally alleged that Martinez obstructed medical judgements by overlooking treatment recommendations and dismissing expert assessments.

Previously, Berry had tried to sort things out with Martinez through several informal discussions, even covering the costs herself. However, after their last meeting in February, she believed that legal action seemed to be the most viable option.

Olivier blatantly disregards the legal bindings set forth by the Court, repeatedly encroaching upon my parental rights. He not only withholds crucial information from me but also makes decisions unilaterally concerning Maceo’s well-being. However, I firmly believe that taking a stand to protect my son is in his best interest.

In his court submission on Friday, Martinez perceived Berry’s single custody demand as a strategic attempt to “manipulate the system” and “secure a surprise verdict,” leaving him financially ruined. (Berry has persistently declined to cover Martinez’s legal expenses, citing a significant disparity in their financial situations.)

“For months, the other party has been using her substantial earnings in an attempt to fabricate a story suggesting cooperation with the petitioner, a claim she couldn’t fully address due to financial constraints. Now, intending to overstep the respondent’s rights and gain exclusive control over significant decisions concerning Maceo’s life, she plans to cover any attorney fees, according to Martinez’s filing.”

The document states, “The Respondent should not have to waive his entitlement to the discovery process or inadequate preparation time for his reply, just because the Petitioner is trying to pressure and rush him into compliance.”

Alongside extending the case, Martinez has asked the court to schedule a hearing about the expenses he expects from Berry’s fresh lawsuit, which he is unable to afford.
