A federal judge threw out a lawsuit brought by a former Fox News producer who alleged he was fired for questioning the network’s coverage of false claims about the 2020 election and the January 6th Capitol riot. The producer claimed he was retaliated against for challenging the network’s reporting on these issues related to President Trump.
On September 28, 2022, reporter and producer Jason Donner was fired from the network’s Washington bureau. He had called in sick two days prior, and was informed his termination was due to that absence.
In 2023, Donner sued, claiming he was fired because he questioned the accuracy of the network’s reporting on multiple occasions.
On Monday, U.S. District Judge Amir Ali ruled that Donner didn’t follow company policy and therefore wasn’t covered by Washington D.C.’s sick leave law.
Donner’s attorney did not immediately respond to a request for comment.
The lawsuit revealed that Fox News leaders reprimanded their journalists for failing to take into account the emotions of viewers who supported Donald Trump after Joe Biden won the election.

A recent court filing by Dominion Voting Systems shows the private thoughts of some Fox News leaders and on-air personalities regarding the false claims of voter fraud made by Donald Trump.
These statements are backed up by court testimony and evidence from the defamation lawsuit Dominion Voting Systems brought against Fox News, which they settled for $787.5 million in April.
However, Ali also pointed out that Donner was an at-will employee, meaning he could be fired for any reason. The court found that Donner didn’t demonstrate a clear public interest that would have prevented Fox from firing him, even if his objections to the network’s programming were valid.
U.S. District Judge Christopher Cooper made a similar decision in 2024 when he rejected that part of Donner’s case.
Honestly, as a big fan of Fox News, I wasn’t surprised at all by the court’s decision. They always said this lawsuit was baseless, and I’m glad the court agreed. It’s a relief to see things resolved in their favor.
