In September 2023, the Consumer and Business Services department of South Australia initiated an examination into the activities of a membership-based company owned by a businessman from Melbourne.

The South Australian government department announced that they were taking legal action against Adrian and his company, LMCT+ (traded as Xclusive Tech Pty Ltd), the day following the Coles giveaway incident.

Adrian is individually charged with nine instances of operating or aiding in the operation of an illegal lottery, while the company is accused of ten similar offenses. These charges were upheld by the court.

If convicted on all charges, he could face a maximum penalty of $190,000. 

The initial hearing for the case has been set for January 15 at the South Australian Magistrates’ Court.

Critics who oppose gambling have alleged that he exploits Australians with lower income, charging as much as $100 per month for lottery games.

However, the company claims it operates as a ‘loyalty program for customers,’ raking in substantial profits for local enterprises.

Over 300,000 individuals are subscribers, and they can choose monthly plans that range from $20 up to $100.

Users who register will gain access to exclusive discounts from partners like Amazon, Temple & Webster, and Elite Supplements; however, specifics about these deals are only shared with those who choose to sign up.

The primary allure lies in the monthly raffles held by the company for money, vehicles, and houses as prizes. In the latest drawing, which took place on November 24, a single participant won an impressive million dollars.
