After a long legal fight, Beyoncé has finally won the right to trademark her 12-year-old daughter Blue Ivy’s name.
On Tuesday, it was announced that the 43-year-old sensation successfully won her legal battle against a small Wisconsin shop over the right to use the term ‘Blue Ivy’. This case had been ongoing since September 2009, as the shop had previously held the trademark for this phrase. This information comes from The Trademark Official Gazette.
In early 2012, the artist behind “Single Ladies” initially encountered issues with regulatory bodies, coinciding with the birth of her firstborn child.
Her company, BGK Trademark Holdings LLC, submitted an application for a trademark at the United States Patent and Trademark Office. However, she encountered opposition from wedding planner Veronica Morales, who contested the application made by the celebrity.
It was demonstrated through legal records that Morales’ business had been known as Blue Ivy Events for a period of three years before the pop star filed her paperwork.
In 2020, as reported by the source, a tribunal took place where the USPTO dismissed the businesswoman’s claims. The reason given was that the similarity between her event planning company and Beyoncé’s daughter’s name was not substantial enough to warrant approval.
Despite her victory in the 2020 tribunal, the legal team of the Texas Hold ‘Em singer decided against pursuing the case related to ‘Blue Ivy’. This decision eventually resulted in the case being dropped or left unattended at that point in time.
In November 2023, Beyoncé re-applied for a trademark, but the application faced preliminary obstacles due to the fact that a Wisconsin boutique already owns the rights to the Blue Ivy logo.
According to the examiner, there was a strong resemblance or confusion between the name of the store (which has been its owner since 2011) and the daughter’s name of the famous star.
The boutique didn’t dispute Beyoncé’s application, enabling her to submit it officially for trademark registration, which was announced publicly in The Trademark Official Gazette on December 31.
The document states that if any party thinks their interests could be harmed within 30 days from the publication date due to the registration of the mark, they have the option to submit an opposition notice (or request for an extension) with the Trademark Trial and Appeal Board.
If no objection is raised by January 30th, the attorney for the star will receive a Notice of Approval.
In 2013, Jay-Z, Beyoncé’s spouse and father of Blue Ivy, expressed in an interview with Vanity Fair that they had submitted a trademark application to prevent others from exploiting their daughter’s name for personal gain.
He stated that there was a desire for creating items using our child’s name, but he didn’t want anyone profiting from his baby’s name unjustly.
The Renegade rapper explained to the outlet that it was not our responsibility to act, since you can clearly observe that we have taken no action.
Besides being parents, they have two seven-year-old twins named Rumi and Sir. Right now, applications are in process for two trademarks related to their names.
