
Last week, writer Alex O’Keefe posted a video showing New York MTA police arresting him for what they said was disorderly conduct. He captioned the video with a statement that the United States is becoming increasingly unstable.
Jay O’Keefe, a writer for the TV show “The Bear,” said on Instagram that he was stopped by police on a New York train after a woman complained about his seating. O’Keefe claims the woman objected to him being the only Black person on the train, and he shared a video of the incident online.
MTA police responded to a call at the Fordham Metro-North station in the Bronx on Thursday morning regarding a disruptive passenger. A train conductor reported that a 31-year-old man was sitting in two seats and wouldn’t remove his feet from one of them. According to MTA rules, this behavior – taking up more than one seat or putting feet on seats – is considered disorderly conduct.

Disney faced increasing pressure after deciding to cancel its late-night show. This came following threats from the head of the Federal Communications Commission (FCC), Brendan Carr, and backlash from major TV station owners who disapproved of Jimmy Kimmel’s remarks regarding the shooting of conservative personality Charlie Kirk.
According to police, video from body cameras and the train itself shows O’Keefe stretched his legs across another passenger’s seat. They also state he didn’t follow their instructions to get off the train and onto the platform, and instead refused to board the next train. This caused a six-minute delay for hundreds of other passengers, and ultimately led to O’Keefe being handcuffed and removed from the train.
Police gave O’Keefe a summons for disturbing the peace, but they did not arrest him, according to a statement.
O’Keefe explained what happened on Instagram, saying a woman complained about how he was sitting. She told the train conductor, who then called the police and halted the train. O’Keefe also claims a friend of the woman told him he was no longer the minority in that situation. He stated that police arrested him without speaking to the woman who reported him – the only Black person on the train – and that only other Black passengers filmed the incident.
O’Keefe posted photos on Instagram of the woman who reportedly filed the complaint, as well as another passenger. He also shared a video showing four officers surrounding him while he had his hands behind his back. In the video, he claims, “They just saw a Black man and arrested me.”

A video of O’Keefe’s arrest spread online over the weekend. In a statement released Tuesday, O’Keefe refuted the claims made against him, adding that no Black man wants to become known for a viral arrest video.
After dedicating my life to public service and the arts, hoping to earn respect and improve our nation, I’ve realized that even success can’t shield you from the violence that’s become commonplace. It’s a harsh reality, and a painful irony of American life, he explained.
Besides writing for “The Bear,” O’Keefe has also contributed to the Sunrise Movement, a climate activist group, and worked with Democratic politicians like Ed Markey, Elizabeth Warren, and Charles Booker, as noted on his website. In 2023, he was part of the writing team for “The Bear” that won a WGA Award for best comedy series.
O’Keefe stated the incident happened four days after his wedding, while he was commuting to work. He believes a white person wouldn’t have been treated the same way, pointing out that simply “sitting while Black is not illegal.” He also claims race was a factor in both the incident itself and how the police reacted.
