So, it’s been four years since the tragic shooting on the set of “Rust,” and I just read that Alec Baldwin’s lawsuit – where he claims he was wrongly accused – has been moved to federal court by officials in New Mexico. It’s a big development in the case, and I’m curious to see how it plays out now that it’s at the federal level.
This week’s court filing is the newest development in the ongoing legal battle stemming from the death of cinematographer Halyna Hutchins, who died on set in October 2021.
I was really following the case of Alec Baldwin, the star and producer of that western film, and it was a shock to see him facing a manslaughter charge after the tragic shooting on set. But then, during the trial in July 2024, the judge suddenly dropped the charge! It turned out the prosecutors hadn’t shared some evidence that could have actually helped his defense, which seemed incredibly unfair.
Half a year after the incident, Alec Baldwin filed a lawsuit against the district attorney and special prosecutors in New Mexico, alleging they wrongly pursued legal action against him. Baldwin argued he was being used as a public example to satisfy media demands for someone to blame in the highly publicized case.
The lawsuit was filed against Kari T. Morrissey, the special prosecutor in New Mexico, along with District Attorney Mary Carmack-Altwies and the Santa Fe County sheriff’s deputies who investigated the death of Halyna Hutchins.
The defendants have denied Baldwin’s allegations.

The judge dropped the involuntary manslaughter charge against Alec Baldwin because of concerns that evidence may have been hidden. The decision came after the judge learned about a possible attempt to cover up potentially important information.
Baldwin’s wrongful prosecution suit was first filed in New Mexico court in Santa Fe.
On Tuesday, Morrissey and the other defendants moved the case to federal court, a legal right they have. According to their attorney, Luis Robles of Albuquerque, this was because the lawsuit brought by Mr. Baldwin included claims related to federal civil rights.
In addition, Baldwin does not live in New Mexico, where the case was filed.
Mr. Baldwin has the option to challenge the decision and ask for the case to return to state court. His legal team did not respond to requests for comment on Wednesday.
A New Mexico judge initially dismissed Alec Baldwin’s lawsuit claiming malicious prosecution in July because the case had been inactive for 90 days. However, after Baldwin’s lawyers asked the judge to reconsider, the case was reinstated.
That prompted the defendants’ move to shift the case to the higher court.

Lawyers for Alec Baldwin have repeatedly claimed that police and prosecutors mishandled the investigation, specifically alleging they concealed possible evidence – a group of bullets that could be connected to the one that caused Halyna Hutchins’ death.
