The prosecution now anticipates that music tycoon, Sean ‘Diddy’ Combs, might serve a jail term that is significantly longer than the initial estimate of 4 to 5 years, following his conviction on two charges related to prostitution.
On Thursday, they presented their observation in a court filing submitted to a federal court in Manhattan. Additionally, they argued against Sean Combs’ recent request for a $50 million bail, pending his scheduled sentencing in October.
Around early July, Combs, aged 55, was found not guilty of racketeering conspiracy and sex trafficking allegations which could have resulted in life imprisonment. However, he was found guilty on two charges related to arranging for his girlfriends and male sex workers to travel for the purpose of engaging in sexual encounters that he filmed.
Each prostitution-related charge carries a potential maximum 10 years in prison.
The prosecutors expressed their belief on Thursday that the recommended federal sentencing range, designed to minimize differences in sentences for similar offenses, might exceed four to five years. They suggested instead that it could significantly increase, potentially increasing the likelihood that the defendant, Combs, may attempt to evade imprisonment.

As a devoted follower, I want to highlight that Judge Arun Subramanian has substantial discretion when deciding a sentence and may opt to disregard the non-binding guidelines. According to Combs’ legal team, they believe these guidelines, if accurately computed, would suggest a prison term of 21 to 27 months.
On the day of the ruling, prosecutors emerged victorious in a battle over bail, following the argument by defense attorney Marc Agnifilo that Combs should be released on bail right away.
In my professional opinion, I firmly declined the defense’s petition, as Mr. Combs failed to provide compelling evidence that demonstrates a substantial lack of potential harm to individuals or the community by clear and convincing standards. However, I made it clear that the defense team has the option to revisit this request at a later time.
On that particular day, Agnifilo referred to similar cases to Combs’ conviction where defendants were given bail. Additionally, he emphasized the challenging circumstances at the Metropolitan Detention Center in Brooklyn, where Combs has been detained ever since his September arrest at a Manhattan hotel.
I can’t help but passionately echo his sentiments, as it seems that Combs was subjected to an unjust treatment. It appears that his involvement in a consensual ‘swinging’ arrangement, where he and his partners occasionally invited male escorts to partake in extended sessions of intimacy, has stirred controversy.
In their court filing on Thursday, prosecutors stated that Dwayne Combs would be required to stay in jail before his sentencing if convicted on the charges related to prostitution, unless he could demonstrate extraordinary reasons for not doing so. However, they argued that Combs does not have such circumstances.
In their view, it was argued that he should continue to be imprisoned because he poses a threat to the community. However, this assertion was contested by Agnifilo in his written submissions.


‘Sean Combs has no intention of harming anyone. We stated in court that this jury granted him another chance at life, and he intends to make the most of it, ensuring he won’t put his seven children at risk of losing a father or his four children at risk of losing both parents.’ Agnifilo expressed this sentiment earlier this week.

Previously, a federal judge had voiced severe concerns about the conditions at this facility back in January 2024. The issues highlighted included prolonged lockdowns and subpar medical care. However, it’s important to note that these problems were said to have been significantly addressed before the arrest took place.
The prosecution argued that instances where other defendants were granted bail, as mentioned by Agnifilo, did not hold similarities with the crimes Combs was found guilty of committing. This is especially true given Combs’ history of violent behavior.
As an ardent observer of justice, I’m compelled to emphasize that the defendant’s lengthy record of violent acts, coupled with his persistent attempts to downplay his latest violent behavior, paints a chilling picture of his dangerous nature. This suggests that he is not fit for supervision and poses a significant threat to our community. Unfortunately, the defendant falls short in proving, beyond all reasonable doubt, as required, that he does not pose such a danger to our community.
