On November 8, the separated pair participated in a mediation session. This mediation resulted in a resolution for all issues related to their divorce, which was discussed during their two-day hearing on December 5.
As a die-hard fan, I can’t help but share the thrilling news! It’s been confirmed that the temporary restraining orders, first filed by Nikki on the 30th of September, and then by Artem on October 3rd, have both been swiftly terminated. They no longer stand; they’re effectively null and void.
Furthermore, court documents reveal that Deputies Michael Moore, Gregory Landry, and Ronnie Galindo from the Napa County Sheriff’s Office were summoned to court earlier this month via subpoena.
As a result of the December 5th hearing being postponed or cancelled, the officers are now deemed unnecessary for court proceedings.
In Garcia’s declaration for a restraining order against Chigvintsev, she alleged that he was dismissed from Dancing with the Stars season 33 a week prior to his detainment, and subsequently took on a construction job which she asserted he found demeaning.
Yet, as per the documents submitted by Chigvintsev, he asserted that he found joy in construction work, contrary to the initial assumption.
On August 29, Chigvintsev was apprehended in Yountville, California due to allegations of domestic violence. However, the district attorney’s office in Napa County declined to press charges in this matter.
Later on, Garcia sought a divorce and attempted to obtain sole custody of their four-year-old son Matteo. However, this request was not granted, and both parties were issued temporary protection orders against one another instead.
According to legal documents obtained by DailyMail.com and filed on October 31 in Napa Superior Court, DWTS professional Chigvintsev claims that the distress caused by his arrest and unfounded accusations resulted in significant financial losses for him.
The records state: ‘Contrary to what’s suggested, I haven’t been unable to secure other dancing jobs. Typically, my work as a dancer starts in November and lasts for about 20 weekends. However, following the mug shot incident due to unfounded accusations, I was removed from the website staff list, leading to a loss of more than $100k in earnings.’
Besides me losing my income from social media promotions, it seems she’s still reaping those benefits, given that she prioritized her career over truthfulness when lying to the police, rather than considering the impact on me.
In that particular moment, he needed Nikki to cover his personal expenses as the Temporary Restraining Order (TRO) had been granted without sufficient backing evidence. Essentially, he was asking her to help with his rent payments because he had been evicted from his previous residence. Furthermore, the dancer hoped Nikki would assist in paying some or all of his legal fees and costs as well.
Chigvintsev asserts in the records that Garcia has a tendency towards anger and states: ‘She is the one who often loses her temper. I usually remain calm and keep my distance from it. She shouts, and on August 29, 2024, she was yelling, chasing me, and was the one who physically assaulted me.’
‘It is further a lie that I was growing increasingly angry, snapping at her, and yelling.’
‘I was not violent with her and did not violently grab or yell at her.’
He asserts that they had a disagreement when he was about to undergo surgery, however, she needed to travel to New York instead.
He asserts: ‘We had a disagreement, however, her account isn’t entirely accurate. We had previously agreed, several months prior to my surgery on May 19, 2024, that she would accompany me. I was planning to travel for the surgery, but unfortunately, she seems to have overlooked this arrangement and scheduled work in New York instead.’
After she made it clear that her job took priority over my medical appointment, causing her to depart, our son was left in the care of the nanny. I decided not to travel as planned and remained there instead. Subsequently, she began sending me suggestions for alternative flights, eventually persuading me to go. I have saved the messages as evidence of this turn of events.
In answer to the demand for a Domestic Violence Restraining Order, he asserted that it was him who was being abused, rather than the reverse. He stated that she had thrown shoes at him, pursued him, and attempted to forcefully enter the bedroom.
He expressed that he can no longer rely on her due to multiple reasons. Firstly, she deceived the police to protect her profession at his expense. Secondly, during the court proceedings, she prevented him from seeing their son, Matteo, for nearly a month. This separation was painful for both of them and self-centered on her part. However, he appreciated the court’s 50/50 orders issued on October 15, 2024, which allowed him to regain access to his son again.
In September, Chigvintsev expressed his immense relief and gratitude through a statement to People, as the domestic violence charges leveled against him were dismissed.
He’s found this period particularly challenging, but he’s relieved that truth ultimately triumphed. Regardless of what’s happened, his unwavering commitment is to our son Matteo. This was the message he conveyed.
The skilled ballroom dancer expressed that he views fatherhood as an extraordinary source of joy, and from now on, his primary focus will be on nurturing his son.

It was decided by the judge on October 16th that both parties will have shared custody of their son Matteo. This decision came over a month after Garcia filed for divorce, according to reports from TMZ, based on court documents.
In the petition to the court, Garcia sought full custody of their son, requested a supervisor during Matteo’s visits with the man from Izhevsk, Russia, and demanded that Chigvintsev complete anger management classes. However, the court rejected all these demands, as reported by the media outlet.
Following their separation, a court mandate required Chigvintsev and Garcia to attend co-parenting classes to maintain amicability while they both participate in raising their child.
