At the BFI’s Luminous fundraising gala held at the Roundhouse in London on Tuesday, I, a devoted admirer, found myself feeling light years apart from Martha, the individual who seems to follow me closely. Baby Reindeer star Jessica Gunning was there, radiating an entirely different vibe.

In a stunningly elegant black sequined dress, the 38-year-old actress who garnered an Emmy for her Netflix series appearance, turned heads on the crimson carpet.

Jessica’s attire featured a see-through layer embellished with sparkling beads, and she paired it with striking silver metallic high heels.

Instead of having her unruly, frizzy hair, Martha opted for a more polished look by smoothing out her shiny brown tresses and enhancing her facial attributes with makeup.

Jessica gleamed with joy while mingling with esteemed celebrities such as Hugh Grant, Daisy Edgar-Jones, and the creator and performer of “Baby Reindeer,” Richard Gadd.

baby reindeer’s real-life Martha has received approval to file a lawsuit against Netflix for defamation, following a significant court ruling.

Obtaining a court decree from PEOPLE, it was established that Richard Gadd’s television series qualifies as a “real-life account.” This enables Fiona Harvey to bring a defamation case against the streaming platform.

The court disagreed with Netflix that they had created a fictional story as many of the details of the series were factual, along with a text that starts the show which reads: ‘This is a true story.’ 

Harvey has asserted that while the main character Martha’s life may be inspired by his own, significant elements portrayed in the series, such as serving time in prison or appearing in court, are not accurate depictions of his real-life experiences.

She insists that she has never engaged in stalking towards Gadd, hasn’t been accused of sexual misconduct against him, and doesn’t have any convictions for stalking on record.

Judge Gary Klausner said in his order that ‘there is a major difference between stalking and being convicted of stalking in a court of law,’ ‘inappropriate touching and sexual assault’ and ‘shoving and gouging,’ when comparing the experiences Gadd had with Harvey and that of the one seen on screen with Martha, according to PEOPLE. 

Earlier reports, exclusive to the Mail, disclosed that the author and actor of the series, Richard Gadd, who portrays himself in the show and builds its plot around his personal events, informed Clerkenwell Films that his stalker had not been found guilty in court.

According to reports, Gadd explained to Clerkenwell that the individual in question was under a ‘prohibition order’ – a civil decree, distinct from a criminal charge or conviction for stalking.

The program was actually a dramatized, fictional portrayal, despite its claim of being based on real events, as indicated by its title.

The comedian acknowledged that certain aspects of the tale were subtly altered for more impactful conclusions.

It remains unclear what details Clerkenwell Films provided to Netflix about the circumstances, and what steps they took to ensure compliance.

He added: ‘It’s very emotionally true, obviously: I was severely stalked and severely abused. But we wanted it to exist in the sphere of art, as well as protect the people it’s based on.’

In July, Netflix argued that the court should dismiss the case because a typical person wouldn’t interpret the statements about Harvey as factual assertions.

Instead, the judge argued: ‘The initial episode clearly declares, “This is a true story,” which leads viewers to consider the statements as truth.’

On June 6, Harvey initiated a lawsuit and sought compensation exceeding $170 million, alleging that she endured substantial harassment following the broadcast of the show.

In light of the situation, I found myself ready to take legal action against the show, alleging defamation, negligence, intentional emotional torture, and violations of my right to privacy, among other claims. As a die-hard fan, it’s heartbreaking to see such treatment.
