The latest development in this saga is particularly intriguing, as Ariana Madix and Katie Maloney are now battling it out with their former business partner, Chef Penny Davidi Borsuk, over the restaurant’s trademark.


Ariana Madix and Katie Maloney are locked in a dispute with Penny Davidi Borsuk, the former chef of Something About Her, regarding the trademark of their sandwich shop. This comes after Penny filed a lawsuit against them following the dissolution of their supposed business partnership.

Penny, the executive chef at Something About Her and a star on Vanderpump Rules, was let go from her roles as COO/Director of Culinary prior to the restaurant’s May 2024 opening due to a financial disagreement.

Prior to being terminated from her position, Penny, along with her lawyer husband Jonathan Lee Borsuk, made an application for the trademark of “Something About Her” through their company Put A Fork In It LLC in August 2023. It is claimed that they had obtained approval from both Madix and Maloney for this process.

Although she no longer works for Madix and Maloney, Chef Penny still holds the rights to the upcoming trademark.

In the May 28, 2024 edition of The Trademark Official Gazette, an announcement was made about Something About Her – allowing anyone to challenge it within thirty days following the publication date. After this period, a Notice of Allowance will be issued according to regulations.

DailyMail.com has obtained exclusive information that Madix and Maloney responded to Chef Penny’s legal action by filing an opposition with the help of their lawyer on June 25th.

The reality TV stars were also granted a 90-day extension to oppose it.

Approximately weeks after the event, Madix and Maloney’s legal representative submitted a fresh trademark application for “Something About Her” on July 9.

The documents uncover that apart from opening a restaurant, the business partners have intentions to offer Something About Her merchandise which includes fragrances, candles, phone cases, bags or totes, clothing, and catering services.

New information about the ongoing story of Something About Her emerged within the past few days, with Chef Penny filing a lawsuit against Maloney and Madix, according to TMZ’s report.

I, Penny, claim that Madix and Maloney have not held up their side of our business deal concerning my position at the restaurant.

According to PEOPLE, Penny has made allegations against the duo for failing to abide by the terms outlined in their partnership agreement.

According to Penny’s claim, she was promised a 10% share in the partnership of the restaurant by June 2023 if she helped establish and manage it.

Under the terms of this deal, she asserts that she put in a great deal of effort towards launching the restaurant. Her tasks encompassed registering trademarks for the eating establishment.

Penny asserted that she was supposed to get a monthly paycheck of $7,500 up until January. Her remuneration was then planned to rise to $10,000 per month starting from January.

Now, however, Penny claims Madix and Maloney have denied ever having such a partnership with her.

She’s counting on the judge to honor their accord and grant her the fair recompense she’s entitled to.

After a surprising wait of two years, Something About Her held its grand opening in the heart of West Hollywood in May 2024.

In April Maloney revealed she and Madix were no longer working with Borsuk.

She shared on The Popping Off with Teddi Mellencamp and Emily Simpson podcast that we no longer collaborate with Penny.

Maloney shared that Penny was a joy to work with and did an excellent job. However, in the end, it wasn’t the ideal match for us.

An executive chef named Borsuk has previously worked for Lisa Vanderpump, who was once the boss of Madix and Maloney.

Penny worked with Lisa on both Pump Lounge and Tom Tom.

On her website, she describes herself as both a Culinary Expert and New Business Manager with Sysco Foods.
